CHAPTER-8 INTERRELATIONSHIP BETWEEN LAW AND SOCIETY
- As law and society are two facets of a coin, social issues determine law which control or change society. The relationship of law and society can be further established through social basis of law, social functions of law, sociology of law and structural functionalism.
- If society changes, law will be changed accordingly and sometimes law prevents sudden changes of society. Social control and social change both are established in relation by law and society.
- If there was no society, there would be no law and state. So, one cannot perform in the absence of others. Jurisprudence exists to the extent if there is a society.
- All schools of thought directly or indirectly interact with the relation of law and society.
- Society and law for their respective progress interrelate and influence each other.
- Society in philosophical term generate a ‘group impulse’, which is an impetus for change. Environs on the other hand provides rich quality for change.
- Law is a tool for just society.
- The law is ‘a means to balance between the group impulse and environs for change.
- Law regulated the society. It provides the framework within which a successful society can flourish.
- The absence of an operational legal system permits terrible injustices in the society.
- Laws shapes our lives in a multitude of ways.
- Law creates rights and duties including remedies. For Example: Employment law
- It sets the terms of our employment,
- It provides protection from harm,
- Provides compensation for injury
Thus, state has responsibility to keep the law relevant to the needs of a changing society
